The sixth amendment allows for all criminal prosecutions the right have a speedy trial . Speedy trial protects all defendants from any delay in between indictment or at the beginning of their trial . ” In all criminal prosecutions , the accused shall enjoy the right to a speedy and public trial , by an impartial jury of the State and district wherein the crime shall have been committed . Which district shall have been previously ascertained by law , and to be informed of the nature and cause of the accusation ; to be confronted with the witnesses against him ; to have compulsory process for obtaining witnesses in his favor , and to have the Assistance of Counsel for his defence ” ( Amendments 5 8 : The Justice Amendments , Feb 2019 ) Speedy trial is essential for two main reasons ; the first reason based on the daily cost . The longer a prosecution is in the hold , the more money spent on prisons , and the more money spent on a case which includes lawyer or judges . It is better for the trial to be quick therefore no consequences are accumulating because the longer a victim is in custody , the faster the defendant is usually accused of a felony or may be punishable for a misdemeanor . The second main reason why it is essential to have a speedy trial is so that if there are any presentable witness , they will be freshened and not tampered throughout the process . The longer a hearing postponed , the higher the chances something may occur to the witness and the evidence will tamper . Both of these reason behind the importance of speedy trial can affect the prosecution and defense .
