The first considerations that I think of when requesting a warrant is probable cause . No judge will issue a warrant without any probable cause even under the Patriot Act . Probable Cause is a level of reasonable belief , based on facts that can be articulated , that is required to sue a person in civil court or to arrest and prosecute a person in criminal court . In plain English , PC is how the police know what you are doing and their proof to the Judge to obtain a warrant and seize property or arrest a suspect for wrong doings . The second consideration would be how specific warrants are and when dealing with computer equipment , there are a lot of components . A warrant must specify exactly what they are seizing .
